In PLANEACION MANTENIMIENTO Y PROYECTOS S.A. DE C.V., we are committed to security in all its aspects. Therefore, and in compliance with the Federal Law of Protection of Personal Data in Possession of Individuals, we issue this Privacy Notice to establish the terms and conditions regarding the processing of personal data derived from the business relationship with the individual or legal entity, hereinafter referred to as THE CUSTOMER

For the purposes of this Notice, the terms used herein and not defined herein shall have the meaning attributed to them in the LFDPP. 

Terms and Conditions 

Identity and Address of the Person Responsible 

For purposes of this Privacy Notice "PMP" and/or its affiliates or subsidiaries in Mexican territory, indicated as responsible for the processing of personal data to PLANEACION MANTENIMIENTO Y PROYECTOS S.A. de C.V . residing at Carretera Federal Libre a Miguel Aleman KM. 26, Parque Industrial Star, Apodaca, Nuevo Leon, Mexico, C.P. 66600, hereinafter "PMP". 

Personal Data 

The personal data referred to in this Notice may be sensitive and non-sensitive data that allow "PMP" to develop its products, solutions and services to meet the needs of the CLIENT according to their activity and sector. And that by way of example, but not limited to, consist of name of the CLIENT and / or contacts representing the CLIENT, contact details (phone, e-mail, to name a few), Address, RFC, CURP, as well as financial, administrative and legal data among others essential to provide the requested service. 

"PMP" will obtain personal data either by physical or digital means or through other sources permitted by law such as: 

(a) through our authorized dealers and distributors 

(b) when you contact us by telephone or through our Call Center. 

(c) through the use of the Responsible Party's websites 

(d) through publicly available sources and other means available in the marketplace 

(e) postal mailing, etc., etc. 

Purpose of Data Processing 

"PMP" accepts and acknowledges that it will treat the personal data of the CLIENT. And refers to any action partially or fully automated to be performed and that by way of example but not limited to: collection, recording, organization, storage, use, attention to legal requirements of competent authorities and / or elimination in the databases belonging to "PMP" and that are intended, among others, the following purposes: 

a. Incorporation and updating (if applicable) in our databases, which may include your purchase history, for internal statistical and service improvement purposes. 

b. Assign a user and password that identifies you as a CLIENT of "PMP". 

c. Evaluation as a potential customer. 

d. To provide the services, products and integral solutions required by THE CLIENT

e. To inform about new products and services and other communications for advertising purposes. 

f. Evaluate the quality of the service or products offered by "PMP". 

g. The elaboration and execution of contracts, derived from the commercial relationship. 

h. Compliance with obligations arising from the legal-commercial relationship established between "PMP" and the CLIENT

i. Develop and maintain a file of the CLIENT that will be kept by "PMP" under the conditions that it determines relevant according to local rules and applicable laws.

For compliance with some internal policies "PMP" needs to transfer data of the CLIENT to third parties that "PMP" has contracted to perform on its behalf certain tasks of the service to be provided. To do this, "PMP" will select reliable suppliers who are committed through a contract or other legally binding and permissible means to comply with the necessary security measures to ensure THE CLIENT the protection of their personal data. These selected third parties will have access to the CLIENT 's data for the sole purpose of performing the tasks requested by "PMP". 

"PMP" is obliged to monitor the principles of legality, consent, information, quality, purpose, loyalty, proportionality and responsibility indicated in the LFPDPPP.

Options and means to limit the use or disclosure of data 

"PMP" declares that it has a Quality and Security Policy that supports the culture of information security and is committed to establish and maintain the necessary administrative, legal, technological, technical and physical measures, sufficient and in accordance with its capabilities to protect the personal data of the CLIENT against damage, loss, alteration, destruction, use, access or unauthorized processing. And ensures the security of the information it handles through confidentiality agreements with its employees, service providers, suppliers, customers and visitors. 

It also states that the computer equipment has the necessary security to prevent information leaks. Physical and logical access controls, environmental controls, anti-intrusion protection system, antivirus protection tools and web filters are some of the tools that allow maintaining data security in the information systems of "PMP". 

Means to exercise ARCO rights 

THE CLIENT has the right at any time to exercise their rights of access, rectification, cancellation and opposition to the processing of their personal data by sending a written request via email to ventas@pmpgrupo.mx such request must contain the following information: 

Full name of the CLIENT and e-mail address to receive the response to the request; 

2. Document proving identity and, in case of legal representation, that of the person making the request on behalf of the CLIENT

3. The reason for your request and the arguments that support it, including supporting documents if necessary; 

4. Clear and precise description of the personal data in respect of which you are seeking to exercise any of the aforementioned rights; 

5. Any other element or document that facilitates the location of your personal data. 

"PMP" will notify the CUSTOMER the response to your request to the email you have provided for that purpose within 15 to 20 business days from the date on which it was received. Committing to that if it is appropriate, it becomes effective within fifteen days from the date on which the response is communicated. 

"PMP" is not responsible for any problems that may exist at the time of data transmission, with the e-mail account that the CLIENT has provided to receive notifications or any other cause not attributable to "PMP". 

Changes and modifications to the Privacy Notice 

"PMP" reserves the right to modify and / or change this Privacy Notice at any time and undertakes to inform you through any of the following means:

✓ Notices within the "PMP" facilities; 

✓ E-mail provided by the customer of the personal data;

✓ Notices on the Intranet and/or Internet portal. ( www.pmpgrupo.mx

It is under the responsibility of the CLIENT, to review the changes and updates that "PMP" decides on the Privacy Notice and that is at your disposal in any of the means described for it in this document.

If you wish to exercise your rights of access, rectification, cancellation and opposition indicated in "The Law" with respect to your personal data, you must do so in writing to the address indicated in the previous paragraph. 

All information handled will be protected and safeguarded under the highest standards of security and technology with which "PMP" has, limiting access to your data to the purposes for which they were provided. 

If as a result of his work as an employee, has access to personal data, even those that could be considered as sensitive, either from co-workers, as well as customers of the affiliated companies of "PMP", controlling, subsidiaries or consortium of which it is part, is obliged not to disclose to third parties the information contained in the files of their co-workers or those customers, in accordance with the provisions of "The Law", regardless of the content of such information is embodied either physically, electronically or by any other means. Personal Data that are processed: 

Some personal data that "PMP" obtains, uses, discloses and/or stores are: 

  • Full name.
  • Address.
  • E-mail address.
  • Landline and/or cell phone number.
  • Payment information (such as credit card number or bank account number).
  • Federal Taxpayers Registry.
  • Articles of Incorporation.
  • Tax information.
  • Commercial references.  

Information on financing and loans. 

"PMP" may request copies of some documents in order to corroborate the above information, such as: proof of address, official identification, registration before the RFC, articles of incorporation, etc. 

 "PMP" will treat your personal data only for as long as necessary in order to fulfill the purposes described in this Privacy Notice and / or in accordance with the provisions of the applicable legal provisions. 

Purposes and/or Uses of the personal data collected by "PMP": 

The personal data collected by "PMP" are used to request the products and / or services it provides or offers and, in general, to comply with the obligations arising from the relationship that may be created with you. Your personal data may be used to carry out the following activities, which are necessary and may result from the relationship that may be created with you: 

  • Analysis of its internal structure,
  •  technological and operational capacity and any other type that allows "PMP" to identify its capacity to comply with the activities for which it may be contracted.

Your data may also be processed in order to:

  • Send you publications of "PMP" and companies of the group, which we consider may be of interest to you.
  • Invite you to events organized by "PMP". 

Your personal data may be used for other purposes, provided that such purposes are compatible with those described above and can be considered analogous.

Transfers of personal data 

"PMP" does not sell, assign or transfer your personal data to third parties outside "PMP" without your prior consent. However, "PMP" may transfer your personal data when such transfer is provided by law. Also, your personal data may be transferred when there is a merger or acquisition, since they will be considered as assets of "PMP" (this circumstance will be informed in a timely manner). 

Security of your personal data 

"PMP" has adopted and maintains security measures, administrative, technical and physical, necessary to protect your personal data against damage, loss, alteration, destruction or unauthorized use, access or treatment. 

Your rights regarding your personal data

As the owner of personal data, you may limit your rights of access, rectification, cancellation and opposition, as established by Law. Likewise, you can revoke, at any time, the consent you have given and that was necessary for the processing of your personal data, as well as limit the use or disclosure of the same. The above, by sending your request in writing, via email, in accordance with the requirements of the Act, to "PMP" to carry out your request compras@pmpgrupo.mx 

By way of reference, the ARCO rights are briefly described:

Access- to be informed which of your personal data are contained in the databases of "PMP" and what these personal data are used for, the origin and communications that have been made with them. 

Rectification- to correct or update your personal data in case they are inaccurate or incomplete. You will have the obligation to inform "PMP" of the changes to be made to your personal data, when such changes are only of your knowledge. 

Cancellation- that your personal data be removed in whole or in part from the databases of "PMP". This request will result in a blocking period after which the deletion of the data will proceed. There are cases in which the cancellation will not be possible in terms of the Law and other applicable legal provisions.

Opposition- to oppose for legitimate reasons the processing of your personal data by "PMP" In cases where the opposition concerns the receipt of certain communications, these communications will include the option to opt out of the mailing list and stop receiving them.

It is under the responsibility of the SUPPLIER, review the changes and updates that "PMP" decides on the Privacy Notice and that is at your disposal in any of the means described for it in this document.
